Rehearing Requested In Case Against Ponce The Dog’s “Owner”

Daytona Beach, FL – When the lifetime ban on pet ownership was overturned earlier this month against Travis Archer, the person who beat a nine-month-old Labrador puppy named Ponce to death, the question was, "Could anything be done?" The answer is yes because today, the Office of State Attorney R.J. Larizza in partnership with the Office of the Attorney General Ashley Moody, announced  that they are requesting a Motion for Rehearing in the Fifth District Court of Appeals decision concerning the Travis Archer case.  Appeals Court Overturns Lifetime Ban On Pet Ownership For Volusia County Man The original case, from November 2017, is the reason Ponce’s Law  legislation was enacted. The Offices invoked Florida Appellate Rule of Procedure 9.330(a)(1) states in part that ‘a motionfor rehearing may be filed within 15 days of an order or decision of the court.’ State Attorney R.J. Larizza made the following statement regarding the Motion for Rehearing, “Iwant to thank the Office of Attorney General Ashley Moody and her staff for their hard workand dedication in agreeing to file a Motion for Rehearing in this important case.” Per the motion for rehearing, "The trial court specifically found that the lifetime banwas agreed to by the defense, rejecting the Appellant’s claim to the contrary when he raised this claim for the first time nearly three months after the sentencing hearing where this condition was specifically addressed and imposed by stipulation of both parties.
